1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts, services, and offers provided through the website www.hello-malta.de (hereinafter referred to as „Website“) between

and the customer (hereinafter referred to as „Customer“).
1.2 The Provider offers consulting and support services based on individual agreements. These GTC apply exclusively to consumers (B2C).
1.3 Deviating or supplementary conditions of the Customer do not apply unless the Provider has expressly agreed to them in writing.

2. Conclusion of the Contract
2.1 The contract between the Provider and the Customer is concluded when both parties agree on the type, scope, and terms of the service. This agreement can be made orally, in writing, or electronically (e.g., via email).
2.2 An inquiry from the Customer or an offer from the Provider does not constitute a binding contract. The contract only becomes effective upon explicit agreement by both parties.

3. Services Provided by the Provider
3.1 The Provider offers consulting and support services based on individual agreements. The specific content and scope of the services will be determined between the parties before the conclusion of the contract.
3.2 The Provider is entitled to suspend service delivery if the Customer fails to meet their contractual obligations, particularly their duty to cooperate (see Section 4).

4. Obligations of the Customer
4.1 The Customer is obligated to provide the Provider with all information necessary for the agreed services in a timely and complete manner.
4.2 The Customer is required to attend agreed appointments punctually. If the Customer fails to attend without timely cancellation (at least 48 hours in advance), the Provider may charge the full fee.
4.3 The Customer is liable for any damages resulting from incorrect or incomplete information and indemnifies the Provider against claims from third parties.

5. Prices and Payment Terms
5.1 Prices for the offered services are individually agreed upon and specified in the confirmation email.
5.2 Payment is due as stated on the invoice and must be made promptly upon the due date.
5.3 If the Customer falls into payment default, the Provider is entitled to charge default interest at a rate of 5 percentage points above the base interest rate and to take further legal action.

6. Cancellation and Refund Policy
6.1 The Customer may cancel a booked service free of charge up to 48 hours before the scheduled start.
6.2 If cancellation occurs within 48 hours of the scheduled start or if the Customer fails to appear, the Provider is entitled to charge the full fee.
6.3 If the Provider is unable to perform the service due to circumstances beyond their control (e.g., force majeure), an alternative date will be arranged. Refunds are excluded in this case.

7. Liability
7.1 The Provider is only liable for damages caused by intentional or grossly negligent conduct.
7.2 The Provider is liable for simple negligence only in the event of a breach of essential contractual obligations, with liability limited to foreseeable damages.
7.3 Liability for indirect damages, lost profits, or extraordinary circumstances is excluded to the extent permitted by law.
7.4 The Customer must ensure that they fulfill their contractual obligations. If the Customer fails to meet these obligations, they forfeit any claims to service delivery, refunds, or compensation.
7.5 The Provider is not liable for delays or deficiencies caused by incomplete, delayed, or incorrect information provided by the Customer.

8. Data Protection

9. Final Provisions
9.1 The laws of the Republic of Malta apply.
9.2 The place of jurisdiction is St. Pauls Bay, Malta, provided the Customer is a merchant or a legal entity under public law.
9.3 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
